Terms and Conditions

The following sets out the terms and conditions for booking a tour with Earthwise.

TOUR  BOOKING  CONDITIONS

BOOKING and PAYMENTS: Before completing your reservation you must have read the terms of these booking conditions. A reservation is only accepted by Earth Wise as confirmed after the Tour Booking Form has been signed or an E-mail accepting the Tour/Programme has been received: the appropriate deposit is paid and when the person making the booking has received Earth Wise Booking Confirmation in respect of the Tour. (Your receipt of our  Booking Confirmation denotes your acceptance of these Tour Booking Conditions)

BALANCE PAYMENT : This must be paid not less than 8 weeks prior to the departure date as shown on the Tour Invoice. Any late booking (where possible) less than 8 weeks prior to departure will require the full payment of the Tour cost (and plus any insurance payment ) to be made at the time of booking. (Unless subject to special agreement as notified on the Tour Invoice). All rates are subject to change if the rate of VAT is amended or if new taxes regarding the services provided by other carriers or establishements are introduced. We will absorb the first 2% of any such surcharges. The Client is responsible to pay any bank charges or other charges as may be necessary to ensure that the complete Invoice charge is payable to Earth Wise.

CANCELLATION OF BOOKING AND CHARGES : If you have to cancel your holiday inform Earth Wise immediately. Written or e-mail  confirmation of the cancellation must then be sent without delay by the person who signed the Tour Booking Form. In most cases your (own) Travel  Insurance should be claimed to reimburse you for any cancellation charges.

Upon such cancellation the person who made the booking is responsible for payment of the following charges :

Deposits are not refundable

Cancellation date more than 56 days from Departure date – loss of Deposit only

Cancellation date between 55 –29 days from Departure date – 65% of the total Tour Invoice                             

Cancellation date 28 to 20 days prior to the day of Departure – 80% of the total Tour Invoice

Cancellation 19 to 16 days prior to the day of Departure  95% of the total Tour Invoice

Cancellation within 15 days of Departure  or during actual tour– Full payment of Tour Invoice

Late payments may incur a penalty interest of 10% but late bookings are not subject to penalties.

Plus if required any additional charges paid in advance by Earth Wise on behalf of Client`s programme which cannot be recovered (for accommodation/car hire or whatever as appropriate )

Note: If the reason for cancellation is covered under the terms of a Travel Insurance policy, you may be able to reclaim these charges after any excess applicable to your policy. By confirming your booking you are acknowledging that you and your party have taken out ,and are covered by an appropriate Travel Insurance Policy in respect of this tour.

CANCELLATION OF TOUR: Should circumstances beyond the control of Earth Wise cause us to cancel a tour the refund of all your payments will be made (less an administrative handling charge of £50) or an alternative tour period will be agreed with the Client.

CHANGES TO YOUR BOOKING: If you wish to make changes to your booking ( e.g. pick-up point, passenger names, departure date) we will do our best to help. We may, however, charge an “Amendment Fee” of up to €30-00 per person to cover the administration cost.

CONDITIONS OF CARRIAGE: Earth Wise accepts your booking in good faith and that there are no reasons of extreme infirmity or incapability which would make it unwise for clients to embark on the Tour/Programme. The safety and wellbeing of passengers during the touring are the Tour Director or Driver`s responsibility and his/her authority must be respected. Every care will be exercised in the arrangement of tours but Earth Wise cannot be expected to take responsibility for totally unexpected or unforeseen circumstances.

CHANGES TO JOURNEYS AND EXCURSIONS : Changes may be made to respond to –adverse weather conditions-road repairs-road congestion-local factors etc. or can be requested by clients during the tour in which case we will do our best to assist. On some tours you have the opportunity to take part in visits or activities for which a charge may be made outwith the price of the tour. The decision to avail yourself of these rests with you.

COMPLAINTS : You are obliged to communicate at the earliest opportunity any failure in services which you perceive at the place at which these services are provided whenever possible with Jackie or driver present. If the matter concerns a hotel or holiday centre/facility the complaint must be taken up with a senior manager or the owner and a written report be prepared detailing the circumstances if these cannot be dealt with to your satisfaction at the time.

ESCORTED TOUR: Where the tour is escorted throughout we will collect, take and deliver individuals to all places en route and, as required and agreed, from home(s) or other collection points.  General details about the tour and locations, venues and attractions will be provided by Earth Wise as per interests of clients.

ACCOMMODATION: We advise on selected and inspected hotels; guest houses or B&B establishments. On some tours accommodation may be recommended by clients at their request but all accommodation bookings to hotels should be made by client unless part of group tour.

INAPPROPRIATE BEHAVIOUR: If the behaviour of any member of any party is considered likely to cause offence, danger, damage or distress to others we reserve the right at all times to cancel or terminate a holiday completely. If this situation arises our responsibility will cease and the company will be under no obligation to cover expenses incurred and neither will we consider or accept any claims for compensation or refunds whatsoever.

These booking conditions set out the terms on which your contract with Earth Wise is based. Your contract will be governed by and construed in accordance with Irish Law and will be subject to the exclusive jurisdiction of the Courts of Ireland for Ireland and similarly for Scotland.
